Let the second quarter of 2018 begin! Can you believe how fast those first three months flew by? And BOMA Greater Tampa Bay was busy! We had our annual Winter Business Meeting on the Hill, Tally Day, a successful BOMI education class, and luncheons where we learned about new construction codes and met our new Hillsborough County Sheriff! Not to mention an extremely successful Property Manager Showcase! Thank you to all who were part of this terrific event!
Additionally, our committees have also been in full swing. Have you found your spot yet? We have a number of opportunities available for you and a place for everyone. With all of the horrific events that have occurred in our country over the past three months, our April luncheon will be focused on Active Shooter Preparedness in the Workplace. We know this is a topic that no one wants to discuss and we all hope to never need, but everyone needs to be aware and ready. We are pleased to bring Ollie Gagnon, Supervisory Protective Security Advisor with the U.S. Department of Homeland Security to speak to our members. Government Affairs Update
State of Florida Update: BOMA’S voices are being heard!
Florida’s 2018 budget permanently lowers the sales tax charged on commercial leases from 5.8 percent to 5.7 percent. A modest reduction to say the least, but it shows the legislature is committed to eventually whittling away the sales tax charged on rent, which is only imposed in the State of Florida. Governor Rick Scott has until March 29 to approve or veto the budget.
Also important to BOMA Florida was the successful derailing of HB 299, which would have removed a BOMA representative from the Building Commission. BOMA strongly opposed the bill and it died in committee.
These victories show how important BOMA is to the commercial real estate industry, and how our efforts and BOMA directly benefit our members and owners.
Federal Update: ADA Reform Passes House
Earlier this month, BOMA achieved a major victory in the battle against so-called “drive-by” lawsuits. These lawsuits are often designed to result in quick financial settlements rather than to remedy the alleged infraction of the Americans with Disabilities Act (ADA) or to increase accessibility. H.R. 620, the ADA Education and Reform Act of 2017, sponsored by Reps. Ted Poe (R-Texas) and Scott Peters (D-Calif.), passed the U.S. House of Representatives with bipartisan support. The House-passed bill would create a “notice and cure” period of 120 days to allow building owners and other businesses the chance to remedy an accessibility issue before the commencement of litigation.
Similar legislation now must be passed in the Senate, and BOMA International is working with legislators to build upon this momentum and move the issue forward.
